Online Consignment Agreement
This online Consignment Agreement ("Agreement") is entered into on
[Date]______________________, between [Your Name]__________________________________, hereinafter referred to as the "Consignor," and PCS CASH [the online Consignment Store],
hereinafter referred to as the "Consignment Store," collectively referred to as the "Parties."1. Consignment Items: The Consignor agrees to identify, inventory, price, upload photos, keep, store, maintain, ship, and deliver his/her household goods (the "Items") for listing at PCS CASH for sale on consignment. Upon approval of the consignor’s account, the consignor shall provide the designated person(s) at PCS
CASH a list of items with brief descriptions, quantities, and estimated pricing. The designated person(s) at PCS CASH shall list the items at PCS CASH where the consignor can log in to his/her
own PCS CASH account to view the items, see which items sold, see pending payouts, and see payout history.

2. Consignment Period: This Agreement shall commence on the effective date mentioned above and continue for a period of thirty six (36) months or three (3) years, unless terminated earlier in accordance with the terms of this Agreement.

3. Pricing and Sale Terms: 3.1. Pricing: PCS CASH together with the consignor will determine the selling price of the items, considering factors such as the condition, demand, and market conditions.
3.2. Commission: The Consignment Store will retain a commission of thirteen (13) Percentage (%) of the sale price for each Item sold. Two (2) Percentage (%) of the sale price for each item sold will go
either to a Combined Federal Campaign Charity or to the International Committee of the Red Cross. The Consignor will receive eighty five (85) Percentage (%) of the sale price for each item sold.
3.3. Discount Sales: The PCS CASH together with the consignor may, at its discretion, offer discounts or promotions on the Items, in which case the commission percentages on the reduced
sale price shall be applied.

4. Payment and Settlement: 4.1. Payment Frequency: PCS CASH will make payments to the Consignor on a monthly, that is at the end of the month, accompanied by a statement detailing all transactions and sales. 
4.2. Payment Method: Payments will be made to the Consignor via PayPal, Google Pay, Apple Pay, Ricochet Pay, other online or mobile banking method, or traditional methods electronic checks and
wire transfer as indicated by the Consignor and agreed upon by PCS CASH.
5. Unsold Items: 
5.1. Unsold Items: Any Items that remain unsold at the end of the consignment period will be deleted from the listing of items for sale at PCS CASH webstore.
5.2. Pickup or Shipping Costs: The Consignor is responsible for any costs associated with the pickup, shipping, or delivery of sold Items. The consignor shall decide with the buyer(s) on method,
cost of shipping, and delivery of sold items. PCS CASH recommends the consignor to use shipping and/or logistics companies such as FedEx, UPS, DHL, USPS, Ceva Logistics, C.H. Robinson,
Kuehne+Nagel, Schneider Logistics, XPO Logistics, J.B. Hunt, and local shipping and delivery services in your specific country.

6. Termination: Either party may terminate this Agreement with written notice of thirty (30) days, the Termination Notice Period. Upon termination, PCS CASH shall cancel, end, terminate, and delete all listings from the Consignor. Any pending sales, payouts, and similar concerns shall be resolved within seven (7) calendar days. PCS CASH shall also cancel, end, terminate, and delete the Consignor’s account
and data at PCS CASH. PCS CASH shall keep as needed data required for recordkeeping, bookkeeping, and governmental compliance such as for IRS, state comptroller’s office, and so on.

7. Condition and Liability: The Consignor represents and warrants that the Items are in saleable condition and in compliance with local, state, country shipping and commerce standards and regulations. PCS CASH will not be held responsible for any damage, loss, or theft of the Items before, during, and after shipping and delivery of the items.

8. Marketing and Promotion: PCS CASH may use photographs and descriptions of the Items for marketing and promotional purposes.

9. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Florida, United States of America.

10. Entire Agreement: This Agreement constitutes the entire understanding between the Parties concerning the consignment of household goods and supersedes all prior agreements and understandings, whether oral or written.
